Frequently Asked Questions

US District Judge Leo T. Sorokin of Massachusetts declared the $100,000 H-1B visa fee unlawful on June 8, 2026. In a 42-page ruling, he found that the fee functioned as a tax and that only the US Congress, not the President, has the constitutional authority to impose taxes. The fee has been vacated and is currently blocked, though the Trump administration has announced it will appeal the decision.
